With a separation agreement the parties do remain married to each other. However, if the terms of the agreement have been substantially complied with for a period of more than one year after signature by the spouses, that agreement can be converted into a divorce settlement agreement.

As a parent, New York law says that you are responsible for the financial support of your child until the child turns 21. Child support may include cash payments based upon the income of the parents and the needs of the child; health insurance coverage for the child, as well as expenses not covered by health insurance; child care payments; and extracurricular activities.
