Wingate, Kearney & Cullen, LLP is unique in that it represents both religious and non-sectarian cemeteries in the State of New York. The Firm is not only versed in the requirements of the Religious Corporations law as it relates to religious cemeteries and the Not-for-Profit Corporations law as it relates to non-sectarian cemeteries, but it is extensively familiar with the common law as it relates to cemeteries.
In New York State there are four types of cemeteries: Religious, Not-for-Profit, Private, and Family Cemeteries. The Firm has experience with all four categories.
The Firm renders full service to its cemetery clients, including corporate, labor and employment, union issues, construction, last will and testaments, burial right issues, and grave ownership issues. The Firm also addresses regulatory issues under the jurisdiction of the New York State Division of Cemeteries.
The Firm also assists individuals when issues arise between an individual and a cemetery. These issues include ascertaining ownership of the right of burial, whether or not a disinterment is possible, damage to monuments, and the rights of a party to construct memorials on a grave site.
